Part I is the initial civil case which was brought by the commercial powers of New York to stop Bergh from enforcing the criminal anti-cruelty law. The judge suggests the scope of the law and what Bergh must do to utilize the law. Part II is a second case brought several months latter when the corporate legal guns again try to get Bergh. This time for violating the judges prior opinion. Part III is the claim of one of the stage operators who Bergh personally asserted for overworking a horse. This case represents one of the first prosecutions by Mr. Bergh of the ASPCA under the new New York anti-cruelty law. That this case dealt with the issue of overloading a horse car is appropriate as it was one of the most visible examples of animal abuse of the time. Plaintiff was bitten by the dog that she adopted from Animal Haven, Inc. and sued that entity for personal injuries stemming from the bite. In affirming the decision to dismiss the complaint, this court noted that the adopting parties signed a contract a the time of adoption where they undertook a "lifetime commitment" for the responsible care of the dog. While the contract stipulated that Animal Haven had the right to have the dog returned if the plaintiff breached the contract, this did not reserve a right of ownership of the dog. Further, the contract also explicitly relieved Animal Haven of liability once the dog was in the possession of the adoptive parties.

Citizens wanted access to University records dealing with biomedical research using cats and dogs. These records were created, as required by federal Law, but access to the records was requested under state law. According to the New York Freedom of Information Act (FOIL), documents held by an “agency” should be disclosed. The lower Appellate Division held that s ince the University did not fall under the definition of “agency" under New York Public Officers Law, it was not required to turn over such documents. The New York Court of Appeals, however, found that the Appellate Division's rationale for denying FOIL disclosure was inconsistent with precedent, and that the legislative goal behind FOIL of was liberal disclosure, limited only by narrowly circumscribed specific statutory exemptions. Thus, in reversing the Appellate Division's decision, the Court of Appeals held that the records were subject to disclosure.

This New York appeal reversed the lower court's judgment finding Officer Smith strictly liable for dog-bite injuries sustained by infant plaintiffs. The court found that, in the limited time the officer spent with the dog, the dog acted friendly, playful, and "rambunctious." He did not see the dog growl or lunge at the plaintiff and her family, who were sitting in the precinct house. The testimony adduced at trial did not establish that Officer Smith knew or should have known of the dog's vicious propensities. Further, the court found the evidence was insufficient to show that Officer Smith owned the dog. Rather, he took temporary custody of the abandoned dog with the intention to transport him to the ASPCA, and the dog was in his possession for, at most, a few hours.

In this New York case, Defendant moved to dismiss the complaint of Overdriving, Torturing and Injuring Animals and Failure to Provide Proper Sustenance for Animals (Agriculture and Markets Law § 353), a class A misdemeanor. The charge resulted from allegedly refusing to provide medical care for his dog, Sophie, for a prominent mass protruding from her rear end. This Court held that the statute constitutional as applied, the complaint facially sufficient, and that the interests of justice do not warrant dismissal. Defendant argued that the Information charges Defendant with failure to provide medical care for a dog, and that A.M.L. § 353 should not be read to cover this situation. However, the Court found that the complaint raises an “omission or neglect” permitting unjustifiable pain or suffering, which is facially sufficient.
Summary:
This New York case came before this Court after the District Attorney refused to prosecute the case. The complaintant alleged that on April 16, 2008, he was walking down a public sidewalk when a loose dog, later identified as belonging to the defendants, ran up to and bit the complainant on the hand. Police were contacted and a complaint was made to the Village of Westbury Attorney who then advised the complainant to file a formal complaint with the Nassau County District Attorney's office. The District Attorney's office declined to prosecute and instead suggested that the Village handle the matter. This Court held that it has no jurisdiction to hear the misdemeanor charge stemming from the violation of Agriculture & Markets Law § 121 (but then did list the other avenues available for the complaintant). This Court, sua sponte, also held that the Agriculture & Markets Law § 121, as applied to Nassau County Village Justice Courts, is unconstitutional. This was due to the fact that Village Courts have no jurisdiction (or ability, as pointed out by the court) to hear misdemeanors.
