In this Oregon case, defendant appeals a judgment of $700 in damages obtained against him after he shot plaintiff’s dog. The dog had gone onto to defendant’s property and was chasing his chickens. On appeal, the Supreme Court found that because it was a general verdict, there was no way to determine a basis for the jury’s verdict; specifically, whether erroneous instructions on exemplary damages and the proper measure of damages influenced the verdict. Because the Court had the whole record before it (and in the interest of “harmony between neighbors”), the Court fixed the damages at the true market value of the dog ($250).

Defendants were convicted of interfering with agricultural operations under the anti-picketing provision of a criminal statute. The Court of Appeals held that the anti-picketing provision was not facially over-broad under the free speech or free assembly provision of State Constitution. The provision, which imposed criminal penalties on people engaged in picketing but created an exception for those involved in a labor protest, did not violate the privileges and immunities clause of the State Constitution, but it did violate equal protection rights under the U.S. Constitution. The statutory presumption of severability did not apply in this case.

Plaintiff and his 12 year-old quarter horse were visiting defendant at defendant's property when defendant's dog rushed at the horse causing it to run into a steel fence. The horse suffered severe head trauma, which necessitated its later euthanization. Plaintiff filed suit for damages asserting liability under common law negligence and O.R.S. 609.140(1) - the statute that allows an owner to recover double damages where livestock is injured due to being injured, chased, or killed by another person's dog. The appellate court agreed with plaintiff that O.R.S. 609.140(1) creates an statutory cause of action independent from negligence. Further, the court found that plaintiff fell within the class of persons the statute aims to protect because the legislature did not intend to limit the statute's application to property owned by the livestock's owner.

In this Oregon case, Defendant shot his neighbor's dog with a razor-bladed hunting arrow. The neighbor euthanized the dog after determining that the dog would not survive the trip to the veterinarian. Defendant was convicted of one count of aggravated first-degree animal abuse under ORS 167.322 (Count 1) and two counts of first-degree animal abuse under ORS 167.320 (Counts 3 and 4). On appeal, Defendant contends that he was entitled to acquittal on Counts 1 and 4 because there was no evidence that the dog would have survived the wound. The court here disagreed, finding "ample evidence" from which a trier of fact could have found that the arrow fatally wounded the dog. As to Defendant's other issues the the merging of the various counts, the accepted one argument that Counts 3 and 4 should have merged, and reversed and remanded for entry of a single conviction for first-degree animal abuse.

Defendant was convicted of first-degree animal abuse, ORS 167.320, in association with having allowed her horse to become so severely emaciated that it was at imminent risk of dying. On appeal, defendant challenged the trial court's denial of her motion to suppress evidence obtained through a warrantless search of the horse. In affirming the lower court, this court found that the warrant exception that allows officers to assist seriously injured people extends to animals under certain circumstances. Citing Fessenden, this court found that a warrantless seizure will be valid when officers have "objectively reasonable belief, based on articulable facts, that the search or seizure is necessary to render immediate aid or assistance to animals that have suffered, or which are imminently threatened with suffering . . ."

This Oregon case considers, as an issue of first impression, whether the emergency aid exception to the warrant requirement applies to animals in need of immediate assistance. Defendant appealed her conviction for second-degree animal neglect (ORS 167.325) based on the condition of her horse. The court found that the emergency aid exception extends to nonhuman animals when law enforcement officers have an objectively reasonable belief that the search or seizure is necessary to render immediate aid or assistance to animals which are imminently threatened with suffering, serious physical injury or cruel death. Here, the deputy sheriff found that the horse was more emaciated than any other horse he had ever seen and there were signs of possible organ failure.
